Regulatory Compliance Fundamentals (Virtual setting)- Tue, 31 Jan, 2023, 9:00 AM – Tue, 28 Feb 2023, 4:00 PM EDT
This 40-hour introductory training program is specifically designed for inspection, investigation and enforcement personnel including by-law. This course will take place every Tuesday until it is completed.
This is a two-day course, and the objective of this program is to strengthen overall communication skills when testifying. The students will learn how to make the most of testimony, what to expect in cross examination, and how to survive it. Students will also build on their basic understanding of the justice system, its workings and the differences in the rules covering testimony before the courts and various tribunals. Students will be given the opportunity to interact with and pose questions to experts from the legal profession as well as experienced regulatory personnel.
Knowing when a regulatory action makes the shift from an inspection to an investigation leading to criminal or quasi-criminal action is a critical success factor for inspectors, auditors, compliance, and enforcement personnel. This one-day technical program starts with a brief explanation as to why it matters and is followed by a discussion of the relevant sections of our Constitution. One can understand that The Courts have taken this concept seriously and have gone as far as providing guidelines as to when a regulatory enquiry turns into a criminal investigation – in other words, when the Rubicon has been crossed! These guidelines will be discussed extensively along with relevant case law. This course goes further in that it explains the pitfalls of wearing both the inspector and investigator hats and details where we stand today.
In this “Enhanced two-day virtual Search Warrant Course” learners will be taken beyond the basic elements of search warrant preparation and execution. Topics to be covered include the search warrant requirements, obtaining a search warrant, court orders, search warrant forms and in order to successfully complete this course, each learner must demonstrate their knowledge by creating an ITO which will determine their final mark. Students will be required to complete independent work in the period between the two live sessions.
